By purchasing or accessing any digital product, course, or service (“Products”) from Earthheld B.V. (“Company”, “we”, “us”), you (“Client”, “you”) agree to the following Terms & Conditions. If you do not agree, please do not purchase or use our Products.
1. Definitions
Products: Online courses, trainings, programs, and digital content, including “Letting Go” and future offerings.
Materials: Videos, audio files, worksheets, PDFs, text, graphics, downloads, and all related content.
Client: Any person purchasing or participating in our Products.
Company: Earthheld B.V., registered in the Netherlands (KvK 98436201).
2. Eligibility
You confirm that you are 18 years or older, legally able to enter into a binding agreement, and understand the nature of somatic practices such as breathwork and sound healing.
3. Nature of Services (Educational Only)
Earthheld B.V., Andrea Rendl, Jens Kemna, and affiliated contributors are not medical doctors, psychotherapists, psychologists, psychiatrists, crisis workers, dieticians, or legal/financial advisors.
Our Products do not diagnose, treat, or cure any medical or psychological condition and are for educational purposes only. If you need medical or therapeutic support, consult a licensed professional.
4. Somatic Practice Disclaimer
Somatic practices may evoke strong physical, emotional, or psychological experiences. These practices may not be suitable for individuals with cardiovascular or respiratory conditions, epilepsy, pregnancy, recent surgery, or those in active psychological crisis.
You are responsible for determining whether you are fit to participate and agree to stop immediately if you experience distress. We do not provide emergency or crisis support.
5. Client Responsibility
You agree that you are fully responsible for your physical, emotional, and psychological wellbeing. No specific results are guaranteed, and outcomes vary between clients.
You agree to use the Materials for personal, non-commercial purposes and to follow all guidelines provided within the Products.
6. Payment Terms
By purchasing a Product, you agree to pay the full price. Payments are processed via Kajabi and associated providers.
Payment plans: If selected, you authorize recurring charges. All installments must be paid. Failed payments may lead to suspended access. Unresolved payments may be forwarded to a collection agency.
7. Refund Policy & EU Withdrawal Waiver
All sales are final. No refunds are issued for any reason.
By purchasing digital content that is available immediately, you explicitly waive your 14-day EU right of withdrawal in accordance with Article 16 of the EU Consumer Rights Directive.
8. Termination
We may suspend or terminate your access without refund if you violate these Terms, behave abusively or disruptively, misuse Materials, share login details, or fail to complete payment obligations.
You remain responsible for all agreed payments.
9. Intellectual Property
All Materials are the exclusive property of Earthheld B.V. You receive a non-transferable, single-user license for personal use only.
You may not copy, share, distribute, reproduce, upload, resell, or use Materials in your own business or courses. Recording or redistributing Materials is prohibited.
10. Community Conduct (If Applicable)
You agree to maintain respectful behavior in any community spaces. Harassment, hate speech, threats, inappropriate content, or sharing other participants’ private information is not permitted. Violation may result in removal without refund.
11. Limitation of Liability
Your participation is voluntary and at your own risk. Earthheld B.V. is not liable for physical, emotional, or psychological harm or any direct or indirect damages arising from participation.
Our total liability, if any, is limited to the amount you paid for the Product. Nothing excludes liability where doing so is prohibited by law.
12. Personal Data & GDPR
We process personal data in accordance with the GDPR. By purchasing, you agree to our Privacy Policy and to receiving necessary program-related communications.

13. International Use
Earthheld B.V. operates from the Netherlands. If you access our Products from outside the Netherlands, you are responsible for complying with your local laws.
14. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes will be resolved by the competent courts in The Hague, Netherlands.

16. Changes to Terms
We may update these Terms at any time. Continued use of our Products indicates acceptance of the updated Terms.
